Afterium Terms of Service

Welcome to Afterium. Please read these Terms of Service ("Terms") carefully before using Afterium's platforms, applications, APIs, or other services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and all terms incorporated by reference. If you do not agree to these Terms, do not use the Services.

Acceptance of Terms

By using Afterium's Services (which include websites, applications, platforms, and APIs related to AI-generated agents, fine-tuning systems, digital memory bots, legal assistants, and personalized educational tools), you agree to these Terms, our Privacy Policy, and any other terms and policies referenced herein. Your use of the Services constitutes your acceptance of all provisions in these Terms. Afterium may amend these Terms from time to time; we will post any changes at this location with an updated "Effective Date." Continued use of the Services after modifications means you accept the updated Terms. If you do not agree to any change, you must stop using the Services.

Eligibility and Accounts

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use most Services. Individuals under 18 may use certain Services only with parental or guardian consent and supervision. By using the Services, you represent and warrant that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Account Registration

Certain features of the Services require an account. When you register for an account, you agree to provide accurate, current, and complete information about yourself. You will choose a secure password and keep your account credentials confidential. You are responsible for all activities under your account, whether or not you have authorized them. You agree to notify Afterium immediately of any unauthorized use of your account or any other breach of security. You may not share your account or login credentials with others, and you may not allow multiple users to use one account.

Single Account

Unless otherwise permitted by Afterium in writing, you may only maintain one account. Afterium reserves the right to refuse registration of, or to cancel, multiple accounts or duplicate accounts.

Services and Use Rights

License to Use Services

Subject to these Terms, Afterium grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services. This license is personal to you and may only be exercised by you or your authorized users (if you use the Services for a business or organization). You may not resell, distribute, or make the Services available to third parties except as expressly permitted by Afterium. All access to and use of the Services must comply with these Terms and any additional guidelines or policies posted by Afterium.

Open vs. Account-Based Services

Afterium may make some features available publicly without an account (the "Open Services") and other features that require registration or payment (the "Account Services"). Use of Open Services is still subject to these Terms. If you register for Account Services, additional terms may apply, which will be communicated at the time of your subscription or enrollment.

Third-Party APIs

The Services may incorporate or rely on third-party APIs and data (for example, language model services, data providers, or cloud infrastructure). Your use of any third-party APIs through Afterium's Services is subject to those third parties' terms. Afterium is not responsible for any third-party services or content, and disclaims any liability arising from them.

User Responsibilities

You agree to use the Services responsibly and in compliance with all applicable laws and these Terms. In particular, you will:

  • Provide true, accurate, current, and complete information as requested by Afterium, and update it to keep it current.
  • Maintain the confidentiality of your account credentials and restrict access to your account to prevent unauthorized use.
  • Be responsible for any activity that occurs under your account or through your account.
  • Use the Services only for lawful purposes. You will not use the Services in any way that violates applicable law, regulation, or the rights of others.
  • Respect intellectual property, publicity, privacy, and other rights of Third Parties. You will not provide any content or instructions that violate another's intellectual property or privacy rights.
  • Promptly notify Afterium of any unauthorized access or breach of security of which you become aware.

Acceptable Use and Prohibited Conduct

Acceptable Use

You may use the Services to generate, process, and analyze content as permitted by these Terms and by any applicable usage limits or guidelines. You may create content (such as text, images, or data) using AI-generated agents, memory bots, or other tools provided by Afterium, subject to the following restrictions.

Prohibited Conduct

You may not use the Services to:

  • Illegal or Harmful Activities: Engage in any unlawful, fraudulent, misleading, or harmful activity. This includes impersonating another person, misrepresenting your affiliation, or using the Services for any illegal purposes.
  • Harassment or Hate: Create or disseminate content that is defamatory, harassing, abusive, threatening, discriminatory, hateful, or illegal.
  • Sexual Exploitation: Generate obscene, pornographic, sexually explicit, or erotic content that violates any law or is not consistent with a general audience.
  • Illegal Advice: Use the Services to generate or obtain advice or instructions on engaging in illegal activities or wrongdoing.
  • Violation of Rights: Create content that infringes on another's intellectual property rights, privacy rights, or publicity rights.
  • Computer Harm: Introduce viruses, trojan horses, malware, or other malicious code. Attempt to reverse engineer, decompile, or hack any part of the Services.
  • Disruption: Interfere with the integrity or performance of the Services, or attempt to gain unauthorized access to the Services or its related systems or networks.
  • Excessive Usage: Use the Services beyond any published rate limits or quotas. Attempt to disrupt or overload the Services.

AI-Generated Content Disclaimers

The Services use AI and generative technologies to produce content. You understand and agree to the following:

  • No Professional Advice: The Services may produce content that resembles legal, medical, financial, or other professional advice. However, Afterium is not a law firm, medical provider, financial advisor, or professional agency.
  • Use at Your Risk: AI-generated content may be incomplete, biased, inaccurate, or offensive. You are solely responsible for how you use the content.
  • Simulated Personalities: The Services may simulate personalities, characters, or styles of real or fictional individuals. Any such simulations are entirely generated by AI.
  • Digital Memory: Certain Services may retain memory of your past interactions to provide context. This memory is stored as data, which could include sensitive information.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTERIUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSS ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL AFTERIUM'S TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO AFTERIUM IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.
